The statutory legacy (the amount that a surviving spouse will receive if their spouse dies without leaving a valid will will increase from the current level of £250,000 to £270,000 on 6 February 2020.
This applies only where the deceased died leaving a child / children. If there are no children then the surviving spouse will receive the entirety of the deceased's estate under the intestacy rules.
In practice, the intestacy rules do not usually match the testator's intention. It is therefore extremely important to put in place a valid will (especially where the deceased has children or other loved ones that they would wish to provide for).
The change increases the statutory legacy for partners of people who die intestate from £250,000 to £270,000
