On Friday we saw an update on the interaction of furlough and annual leave.

The update confirmed the following information:-

1) An employee or worker who is on furlough can take annual leave whilst they are on furlough;

2) Employees should be paid their "usual" holiday pay for any annual leave taken during a period of furlough.

3) An employer must 'top up' the annual leave payment for periods of annual leave.

There is however still some uncertainty as to whether an employer can require an employee to take annual leave during a period of furlough.

Additionally, it explains that if an employee usually works a Bank Holiday then the employer can agree that this is included in the claim from the employer via the Coronavirus Job Retention Scheme, via the portal (which is now live!).  If the employee usually takes a Bank Holiday as leave then either the employer has to top it up, or give the employee a day of holiday in lieu.

The interesting point , was the is the distinct caveat, stating "during this unprecedented time, we are keeping the policy on holiday pay during furlough under review" and therefore we would expect that further updates could be produced.
